1. The information we collect
The purpose of these General Terms of Use (referred to as “GTU”) is to legally frame the conditions for making the site and services (as defined below) available by Brissoto SARL (hereinafter referred to as “the Company”) and to define the terms and conditions for accessing and using the services by the “User.”
2. Purpose
Brissoto is a company specializing in the design, development, and maintenance of mobile and web applications for third parties. We are committed to providing digital solutions tailored to the specific needs of our clients, whether for custom projects or continuous maintenance of created platforms. We work with various technologies to ensure the performance, security, and scalability of delivered products, thereby guaranteeing an optimal user experience. As a service, we offer **Sendylo**, a “carpooling” platform connecting individuals, and **Heyama**, a service that brings together people looking to form connections.
Any service provided by Brissoto, including the design, development, and maintenance of mobile and web applications, is referred to in these General Terms of Use (GTU) as “Service(s) or Application(s).” Any new features or tools added to the current Services will also be subject to these General Terms of Use. We reserve the right to modify, add, or remove certain features to enhance the user experience or meet technical requirements. The use of the Application implies full and unconditional acceptance of the GTU by the user, hereinafter referred to as the “User(s).”
3. Conditions of access and use
To access and use the Services, you must create an account for free from a smartphone, provided that the User has an internet connection.
You must be at least 21 years old, or at a minimum, the legal age of majority in the jurisdiction in which you reside and from which you use the Services, to open an account.
You agree to comply with these GTU and all applicable local, state, national, and international laws, rules, and regulations.
The User is responsible for the use of any Service and their personal data.
You are responsible for the security of your password. Brissoto cannot and will not be liable for any loss or damage resulting from your failure to maintain the security of your Account and password. We may require additional security measures at any time and reserve the right to adjust these requirements at our discretion.
In certain cases of service usage, Brissoto may request identity verification to ensure the security and integrity of our services. The user will be required to provide either a copy of their identity document along with a selfie clearly showing their face or simply a selfie in a specific pose as requested. These measures are intended to protect both our Users and our services from any fraudulent or unauthorized use.
4. Create an account
Creating an “Account” is required to access the Services after downloading. You can log in using an email address along with a password.
Each User is allowed to have only one personal Account. The use of multiple Accounts to access a Service constitutes a significant violation of these Terms of Service.
It is your responsibility to ensure the confidentiality of your login credentials when registering. You assume full responsibility for any activity carried out using these credentials.
5.Control of accounts
If a user is suspected of not complying with the access and usage conditions stated above, their account may be suspended for investigation. If the violation is confirmed, the account may be immediately deleted by Brissoto, and the User may be banned from the relevant Service.
6. Payments
For the use of Services offered by Brissoto, several payment options are available to facilitate transactions and meet the needs of our customers.
The accepted payment methods are as follows:
– Credit Card: Payments can be made via Visa, MasterCard, and other recognized credit/debit cards.
– PayPal: You can use PayPal to securely pay for services.
– Apple Pay: Apple product users have the option to make payments via Apple Pay.
– Mobile Money: For our customers based in Africa, Mobile Money payment is also available, offering a simple and efficient method.
All transactions made using these payment methods are secure, and we do not store any banking information from our users. It is important to ensure that the information provided during the payment process is accurate to guarantee the success of the transaction.
Invoices corresponding to the ordered services will be available upon payment confirmation.
Refund
We are committed to offering quality services to our Users. However, we understand that certain situations may require a refund.
Refund Conditions:
- Refund Request: Any refund request must be made within 7 days from the date of purchase or service delivery. Beyond this period, no refund request will be considered.
- Eligible Cases for Refund:
- In case of a proven malfunction of the service provided, or if it was not delivered according to the initial specifications defined in the contract.
- In case of project cancellation before it starts or during the early development phases, subject to Brissoto’s approval.
- Non-Eligible Cases:
- Projects that have already been completed and fully delivered are non-refundable, except in the case of serious technical defects, verified and approved by Brissoto.
- Personalized or custom-made services (web or mobile applications developed specifically for a client) are non-refundable once the design/development work has started.
- Refund Procedure:
- To request a refund, please contact our customer service at contact@brissoto.com with your transaction details and a clear explanation of the issue encountered. We will process your request as soon as possible and inform you of the outcome within 14 working days.
- Refunds will be made using the same payment method as used for the purchase, whether by credit card, PayPal, Apple Pay, or Mobile Money.
Brissoto reserves the right to refuse any refund request if the conditions mentioned above are not met.
7. User Code of Conduct
User engagement
Any User agrees not to:
- Share, distribute, download, or otherwise use content communicated or distributed by another User through one of our Services without prior written permission;
- Violate standards of decency and must remain respectful towards other Users;
- Use robots, tools, or software other than those provided by the Company within a Service when contacting other Users;
- – Disclose their login details to the Service to other Users;
- Harm the proper functioning of a Service or damage the Company’s reputation;
- Make copies, distribute, or transfer technical data intercepted on the network related to a Service.
Any breach of the above obligations constitutes a serious violation of these Terms of Use, which may result in the termination of the User’s Account.
Content distribution
The User is solely responsible for the Content they distribute through a Service, and Brissoto cannot be held liable for the communication of such Content.
In fact, every User agrees not to distribute any Content that:
- Is contrary to public order and good morals;
- Is defamatory, offensive, racist, xenophobic, revisionist, or harms the honor or reputation of others;
- Incites hatred or violence towards a person or group of people due to their origin, ethnicity, nationality, race, or religion;
- Depicts nudity;
- Is pornographic in nature;
- Involves child pornography;
- Encourages the commission of a crime, an offense, or an act of terrorism, or glorifies war crimes or crimes against humanity;
- Incites suicide;
- Violates intellectual property laws;
- And generally, violates the laws and regulations in force.
Brissoto reserves the right to remove any Content that violates these Terms of Use or infringes on the rights of third parties as soon as it becomes aware of such violations.
Any breach of the above obligations constitutes a serious violation of these Terms of Use and may result in the termination of the User’s Account
8. Disconnection, uninstallation or deletion of account by user
Logging out
The User may log out of his or her Account at any time without notice via the application. When logging out of the Account, the User’s Profile remains visible to other Users.
Uninstalling the Application
The user is free to uninstall the application at any time without notice. However, even if you do not log out of your account beforehand, your profile will remain visible to other users for the future.
Account Deletion by the User
The User can permanently delete their Account at any time by going to the “Settings” tab in the Application.
Upon account deletion:
- The User’s Profile will be permanently deleted and made invisible to other Users;
- The User’s data will be permanently erased.
Account deletion is final. If the User wishes to start using the Application again, they will be required to register under the same conditions as for a first-time registration
9. Application Modifications and Termination
Brissoto is continually working to enhance its Services and add new features to make them more engaging and useful for Users. As part of this process, we may add or remove certain features without prior notice if such changes do not significantly affect your rights or obligations. In exceptional circumstances, such as security issues, we may temporarily suspend the service without prior notice. However, whenever possible, we will notify you in advance of any major changes.
Brissoto reserves the right to terminate your account at any time and without notice if we believe that you have violated the terms of this agreement.
10. Safety of Your Interactions with Other Members
Brissoto encourages a respectful experience between its members through the messaging feature of the Application. However, the conduct of any member on or off the Application is not the responsibility of Brissoto. It is your responsibility to exercise caution in all interactions with other members, especially if you decide to communicate outside the Application or meet in person. You should also follow Brissoto’s safety tips and avoid sharing your financial information or transferring money to other members.
11. Disclaimer
Brissoto does not guarantee that the Application will operate without interruption or error, nor that any content or information you obtain through the Application will be accurate. Brissoto also disclaims any responsibility for any content posted, sent, or received by you or other members via the Application. Accessing any material downloaded or obtained through the use of the Application is at your own risk.
12. Limitation of Liability
Brissoto, its affiliates, employees, licensors, or service providers shall not be liable for any indirect, consequential, exemplary, incidental, special, punitive, or enhanced damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, related to access, use, or inability to access or use the Application. However, some jurisdictions may not allow the exclusion or limitation of certain damages, which could render some or all of the exclusions and limitations in this section inapplicable.
13. Indemnification
Users agree to indemnify, defend, and hold harmless Brissoto from any claims, demands, lawsuits, damages, losses, costs, liabilities, and expenses (including attorneys’ fees) arising from the User’s violation of these Terms of Service
14. Governing Law and Jurisdiction
These Terms of Service are governed by Cameroonian law.
In the event of a dispute between the Parties, the User shall first address the internal teams of Brissoto to attempt to negotiate an amicable solution.
